Terms & Conditions
Welcome to the Maggie & Co website terms and conditions for use. Please read through them carefully before placing your order. By using this website and/or placing an order you agree to be bound by these terms and conditions. They govern your use of the website and your relationship with Maggie & Co. (References to “we” or “us” are also references to Maggie & Co). Please read the terms and conditions carefully as they affect your rights and liabilities under the law. If you do not agree to these terms and conditions, please do not register for or use the website.

Contract
The purchase of goods through Maggie & Co is strictly limited to parties who can lawfully enter into and form contracts on the website in accordance with English Law.
In order to make purchases through the site, you will be requested to register and provide your personal details. In particular, customers must provide their real name, telephone number, email address and other requested information as indicated.
The website is available for non-commercial and domestic use only. Maggie & Co reserves the right to refuse orders from businesses or that we consider are for commercial or other non-domestic concerns. We also reserve the right to restrict multiple quantities of an item being shipped to any one customer or postal address.
Product Information
All stock sold through our website is genuine end of season designer wear.
We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the product on delivery.
All sizes and measurements are approximate; however we do make every effort to ensure they are as accurate as possible.
We will take all reasonable care to ensure that all details, descriptions and prices of garments and accessories appearing on the website are correct at the time when the information was entered on the system. We reserve the right to refuse to supply an order where information has been mis-published including prices and promotions.
All prices are inclusive of V.A.T.
Goods are subject to availability. As there is a delay between the time when the order is placed and the time when the order is accepted, the stock position relating to the particular items may change. If an item you have ordered becomes out of stock we shall notify you as soon as possible. You will receive a full refund for the out of stock item.
Your Order
All orders are subject to acceptance by Maggie & Co and to availability.
Your order is an offer to buy from Maggie & Co, which may be accepted or declined by us. Please note that our products for sale are those in stock and available for dispatch from our distribution centre. On occasion, demand may exceed stock and we will sell out of some items. If this is the case we will email you and let you know that we are unable to fulfil your order. We will not make any substitutions. We apologise in advance but this is due to our stock being limited and of an exclusive nature.
We reserve the right to refuse an order. Non-acceptance of an order may, for example, result from one of the following: the product ordered being unavailable from stock, or our inability to obtain authorisation of payment, or the identification of an error within the product information, including price or promotion.
At the moment that the goods are ordered, a contract will be made between you and us, and you will be charged for the goods.
If there are any problems with your order we will contact you.
Delivery Information
Delivery Area: delivery can only be made to UK addresses.
Delivery Times: we aim to deliver within 3-5 working days (Mon-Fri) of notification to you of acceptance of your order. Orders placed after 12.00 noon may take an extra day. We will not be liable if we fail to deliver in the time stated if this is in part or in full due to circumstances beyond our control.
Delivery Charges: All orders are shipped free of charge.
Maggie & Co uses Royal Mail Special Delivery. As deliveries are sent Special Delivery they will have to be signed for upon receipt. All items that have been attempted to be delivered by Royal Mail will be held at the appropriate Royal Mail sorting office for 15 working days, and then returned to Maggie & Co. All undelivered returned items will be charged at £10 for the postal cost of redelivery. Delivery Address Options: you can only specify a delivery address which is different from your billing address if it is your place of work.

Once goods have been delivered to you they are at your risk and you are liable for their loss or destruction.
Payment Options
We will accept payment by Delta, MasterCard, Solo, Switch, Maestro, Visa, Visa Electron cards.
The price you see is the price you pay for each item. If, by mistake, we have under-priced an item, we will not be liable to supply that item to you at the stated price provided that we notify you before we dispatch the item concerned.
We only accept payment in British Pounds Sterling (£). All prices are inclusive of V.A.T.
Credit Card Validation: All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not authorise payment for any reason then we will notify you by email and not dispatch the order.
Right of Cancellation
You may cancel the contract for the purchase of any item by contacting us at info@maggieandco.co.uk within seven working days of delivery of the item to you. You should then return the relevant item to us in secure packaging to Maggie & Co, The Strand, Torquay, Devon, TQ1 2AA.
You will be responsible for the cost of returning any item to us unless the item is defective or we have delivered the item to you in error. The item should be returned to us in its original condition. If we do not receive the item back from you we may arrange for collection of the item from you at your cost.
When we receive notice of cancellation of your contract for any item, we will refund the price paid by you for that item, subject to our returns policy.
Returns Policy
This returns policy does not affect your statutory rights or the right to cancel.
Returning your goods is simple.
For a full refund items should be returned to us at Maggie & Co, The Strand, Torquay, Devon, TQ1 2AA in secure packaging, within 10 days of receipt of your order, in their original condition. Maggie & Co will not accept returns for any non-faulty items that have been worn and tags removed. When trying on clothes please ensure that you are not wearing any fragrance or deodorant that may leave a scent or mark.
When returning goods to us, please use the form provided with the goods taking care to enter your name and address details where requested.
If you return goods by post, please use either Royal Mail Recorded Delivery (only if value is under £30) or Royal Mail Special Delivery or equivalent.
Please ensure that you obtain a certificate of postage as your insurance against loss or damage.
On receipt of your return we will inspect and deal with the return in conjunction with our returns policy. Any refunds will be made using the same method as the original transaction. Please note that refunds will only be made to the original payment card (because credit card companies only allow refunds to be made to the card used to pay for the original order). Please be aware that it can take as long as seven working days for a refund to be acknowledged by your credit card company.
Statutory Rights:
Your statutory rights are not affected by our returns policy and you will have the benefit of them too.

Applicable Law
These Terms and Conditions are subject to the laws of England and Wales and if you want to take court proceedings you must do so within the United Kingdom.
International Use
Materials on the website may not be appropriate or available for use in locations outside the United Kingdom, and accessing the website from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so at your own risk and are responsible for compliance with local laws.
